Definitions
“LAPORTRA” refers to LAPORTRA portraiture and photography studio, UK. “The Client” means any person, body of persons, publication, agency or company with whom LAPORTRA enters into a contract, verbal or written, for the sale of goods or provision of services by LAPORTRA.  “Portrait session” refers to the service in which the client has their photograph taken by LAPORTRA.  “Headshot” and “portrait” both refer to the photographs taken in the portrait session by LAPORTRA as outlined below.

 

Acceptance of Terms and Conditions
All contracts and transactions between LAPORTRA and the client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between LAPORTRA and all or any of its clients. Terms and conditions will be effective as of booking and carried out from the start of each portrait session.

 

Services
Services and goods consist of photography headshots carried out by photographer and the photographer’s assistant working under the name of LAPORTRA, with the outcome of the work from each photography session being digital files which will be transferred electronically through the clients preferred digital and electronic transfer service. This also includes further images and or prints requested by the client on receipt of the digital files.

 

Copyright, Usage, Ownership & Licence
Photographs are the exclusive property of Rachel Byrne trading as LAPORTRA and are protected under international Copyright, Designs & Patents Act 1988. The copyright of all photographs taken by LAPORTRA is retained by LAPORTRA and cannot be used by a third-party organization unless pre-agreed with LAPORTRA.  No use may be made of the images until payment is made in full; thereafter payment the license terms default to the terms outlined in the individual client’s invoice. Rights and usage fees vary for each project.

 

Exclusivity
LAPORTRA retains the right in all cases to use the photographs taken in each session for purposes none other than promoting their own work across all of LAPORTRA’s social media channels and website. Permission will always be asked whereby their image is used beyond the channels stated above. No client’s portrait will be used in any public advertisement without their prior written consent.

 

Client Confidentiality
LAPORTRA will keep confidential and will not disclose to any third parties or make use of material or information communicated to them in confidence for the purposes of the portrait session.

 

Client Requirements
In any case that the client should request LAPORTRA to visit them to take portraits, the client must provide the following requirements (as also stipulated in our booking guide) otherwise we will be unable to photograph the client and we reserve the right to adapt our service, re-schedule or cancel the job if our requirements have not been met.


We require a minimum space of 2 x 2 meters to set up. 3 x 3 meters or more if the client wants a full length image.
We require a space that’s no more than 2 meters away from a working electrical plug socket.
The client must notify us prior to booking if they wish their portrait session to include more than one person, as pricing may vary depending on amount of people included in each session.


Our shooting requirements as detailed above must be met by the client. Where requirements are not met, we reserve the right to terminate the portrait session or re-schedule to a later date on the condition that our requirements will have been adhered to. In cases where we must cancel a job, any travel and parking fees incurred by LAPORTRA will be billed to the client. The booking fee will not be refunded due to the loss of time.

 

Expenses
Expenses are estimated at the time of commission and charged at cost. Where additional expenses or time are incurred by LAPORTRA as a result of alterations to the original brief by the client or at their request, the client will be liable to pay such extra expenses or fees at LAPORTRAs normal rate in addition to the expenses agreed or estimated. The client will always be notified of this in advance by LAPORTRA.

 

Refunds
The utmost care and attention to detail will be taken in the photographing and processing of each portrait session, however, due to the artistic nature of photography, the client has no right to request a refund of the outcome of their portrait session with LAPORTRA once images have been transferred. Refunds will not be granted in any case after image transfer. Also, to note – if you wish to cancel your booking, it must be done within 48 hours of your sitting, we reserve the right to retain the clients paid booking fee if 48 hours notice has not been given. Any non-refundable travel costs we may have incurred e.g., train tickets will not be refunded.

 

Day Rates & Overtime.
The client must make allowances for setting up and packing away time which takes between fifteen minutes and thirty minutes. Working beyond the agreed time frame with any client will be classed as over time and therefore will be charged at our hourly rate unless otherwise negotiated. The client will be notified once they have reached the overtime threshold.

 

Image Adjustments
One round of amendments or adjustments to the images will be granted free of charge depending on extent of workload this involves. However, LAPORTRA reserves the right to request an adjustment charge depending on scale of adjustment request. Any additional adjustments to the images WILL incur a fee.

 

Payment
Securing the clients booking will requires a booking fee that will be charged at time of booking. Failure to pay within twenty-four hours will result in the booking slot being released and may be given to another client. Booking will not be confirmed until the booking fee/ payment is processed. For corporate clients, and any job where payment is based on hourly work, payment is also expected before the client’s files/ portraits/ images are handed over. Payment for the client’s images and will be required before the images are handed over.

 

Delivery time
Each portrait session will vary in time, though the average individual session can last from fifteen minutes up to two hours. Delivery of the client’s photographs can be expected around three weeks from the day they have selected their chosen images to be edited and confirmed their selection via email. For corporate and group sessions equal to or larger than three people, expect the delivery of the portraits to be up to five weeks after the payment date. Each group session will take around five and fifteen minutes per person. LAPORTRA reserves the right to extend the picture return date, but the client will ALWAYS be notified prior to this date.

 

Termination
On-site, the Photographer reserves the right to terminate any photographic session without notice if they deem the client’s behaviour to be disrespectful or unsafe.

 

High-Speed Services
If work is requested back from LAPORTRA at a faster speed, an additional charge will be requested. This service is subject to availability and cannot be guaranteed due to the variable nature of workload at the time of this service request.

 

Travel Expenses
We travel within London at no extra cost, however any area we travel to outside this region will incur a travel fee that will have been agreed with the client in advance. Entering this contract with LAPORTRA means that the client has agreed to the travel expenses presented to them. In all cases, any parking charges we incur will be billed to the client. Public transport, including but not limited to taxi, train, ferry, and aeroplane are charged at the cost of travel in cases where the photographer is required to travel to the client. In any case where travel expenses will be charged, LAPORTRA will notify the client before booking is confirmed and payments have been made.

 

Images/Data Supplied in Electronic Format
For all images/data supplied to the client in electronic format (including but not limited to electronic mail, WeTransfer, our online gallery, and pen drive etc.), LAPORTRA will endeavour to do everything in its power to ensure that the data sent is not corrupt and is virus-free before dispatch.

 

LAPORTRA cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the client’s computer or data. The client agrees to take similar steps to ensure that data sent to LAPORTRA is not corrupt.

 

Applicable Law
This agreement shall be governed by the laws of England, Wales, and Scotland.

 

Variation
These Terms and Conditions shall not be varied except by agreement in writing.
